Delhi Chief Minister Arvind Kejriwal Granted Bail After Six Months in Liquor Excise Policy Case

September 13, 2024: Delhi Chief Minister Arvind Kejriwal has been granted bail by the Supreme Court, ending his six-month detention in connection with the liquor excise policy case. The Court's decision, made on Friday morning, addresses concerns about his prolonged imprisonment and its impact on his personal freedom.

In a brief but significant ruling, a two-judge bench consisting of Justice Ujjal Bhuyan and Justice Surya Kant agreed that Kejriwal's extended incarceration constituted an unjust deprivation of liberty. This decision follows his earlier release on bail in a related case filed by the Enforcement Directorate (ED).

The Court's judgment came after Kejriwal's arrest by the Central Bureau of Investigation (CBI) in June, just days after the Delhi trial court had granted him bail in the ED case. Kejriwal's defense argued that the CBI's arrest was an "insurance arrest," designed to circumvent his recent bail.

Justice Bhuyan and Justice Kant delivered separate verdicts but concurred on the essential issue of granting bail. Justice Kant, however, upheld the legality of the CBI's actions, stating there was no legal barrier to arresting someone already in custody and dismissing claims of procedural impropriety.
